The Supervisory Board approved changes to the EEF’s programs

On March 20, the Supervisory Board of the Energy Efficiency Fund approved changes to the Energy Modernization Support Program for multi-apartment buildings “ENERGODIM” and the “VidnovyDIM” Program. They come into effect on March 22.

“ENERGODIM”: what’s new

Professional support of energy modernization projects of high-rise buildings

From now on, HOAs can receive a Grant for Project support services, which consist in the preparation of Applications and support of the Beneficiary during his participation in the Program. Only new Beneficiaries who submit Applications for Participation for the implementation of the Package of activities “A” (simplified) in accordance with the provisions of Appendix No. 4 to the “ENERGODIM” Program, starting from March 22, 2024, can apply for the Grant. The amount of partial compensation for Project support services cannot exceed UAH 20,000. For more details about who can provide Project Support Services and what documents should be submitted, see the “ENERGODIM” Program (Section I. Definitions, Appendix 4 to the Program).

Clarified requirements for the Advance Payment Application

  • The Fund introduces a time limit for submitting an Application for a Grant Advance / Residual Grant Advance. Such an Application must be submitted no later than 6 months before the end of the Project Implementation Period, if no step-by-step Application for Verification has yet been approved by the EEF at the time of its submission, and no later than 3 months if at least one Application for Verification in the first step has been approved. The norm applies to new applications that will be submitted starting from 03/22/2024.
  • Besides, regulations were introduced that the Grant Advance is paid by the EEF in the amount of no more than 30% of the estimated cost of Acceptable Construction Work Activities, and the Residual Grant Advance – no more than 30% of the estimated cost of unfulfilled Acceptable Construction Work Activities. That is, the Beneficiary has the right to request not 30% of the Grant Advance/Residual Grant Advance, as it was before, but a smaller amount. For this, he must submit a separate letter in an arbitrary form with the desired size of the Advance.
  • Introduction of a new procedure for paying an advance to the beneficiary, which is carried out within 5 working days from the day the Fund receives a request for its payment. More details in the section XII of the Procedure of Actions of the Participants of the Program “ENERGODIM”.

Change in requirements for applications for verification after the beneficiary receives an advance payment

Changes to the requirements for verification applications after the beneficiary has received an advance payment, which stipulate that at the stage of verification of energy efficiency measures after receiving the advance funds, construction work must be performed in an amount not less than the received advance payment (in detail – in clause 23 of Appendix 1 to the “ENERGODIM” Program).

Establishing the sequence of submission of the Application for changes 

Establishment of the sequence of submission of the Application for Changes to reduce the list and/or cost of construction works when it is intended to receive an advance. Thus, Application No. 3, which provides for a refusal to implement one or more optional energy efficiency measures or a reduction in the cost of these measures based on the results of the adjustment/preparation of new project documentation and its appraisal, is submitted before receiving an advance payment or together with the Application for verification of the completed project / energy efficiency measures of the last step. In case of non-compliance with the specified order of submission of Application No. 3 (Application for Changes), its approval is possible only after the beneficiary returns a part of the advance received for energy efficiency measures or the amount of the reduction in the cost of energy efficiency measures based on the results of the adjustment/preparation of new project documentation and its Appraisal.

   Appraisal in a state organization

From March 22, the rule that Certificates of acceptance of completed construction works drawn up in form No. KB-2v must undergo an appraisal by an expert organization of the state form of ownership or be examined by a court expert has been reinstated. The requirement does not apply to Applications No. 4 submitted before March 22, 2024.

The norm regarding the submission of certain documents to the EEF is reinstated

Reinstatement of the Beneficiary’s obligation to submit, together with Application No. 1 and Application No. 4, copies of documents confirming the fact that the energy auditor is on the staff of a legal entity or an individual entrepreneur (in the case of concluding an agreement on the energy efficiency certification of an apartment building with a legal entity or an individual entrepreneur).

Submission of a printout of the Energy Certificate

Introduction of the need to submit, together with the Application for participation and the Application for verification of the completed project, a printout of the energy certificate and an extract of its registration in the Unified State Electronic System in the field of construction.

Clarified requirements for construction companies and other contractors

Expansion of requirements for contractors for whose construction work advances can be received. Thus, the EEF makes a decision on the non-compliance of the contractor in the event that the EEF rejected the HOA Application within the framework of participation in the programs on the grounds of poor quality or untimely performance of construction works by this contractor or persons related to him. Also, if the EEF had repeated comments on the certificates of acceptance of completed construction works drawn up by the contractor and related persons with various beneficiaries, which contained inaccurate information, which may indicate the intention to mislead the Fund in order to obtain financial or other benefits. Beneficiaries, until March 29, 2024 (inclusive), are allowed to submit, together with the Application for receiving an advance, the Contractor’s Questionnaire according to the form of the previous version of the “ENERGODIM” Program dated September 21, 2023.

The maximum grant amount has been increased

The maximum amount of the grant that a HOA can receive for one restoration object (a house or a part of a house, if more than one HOA is created in the building) has been increased — from UAH 7.9 million to UAH 8 million. As before, the total amount of the grant under the project consists of the amounts of the first and second tranches (70% and 30%, respectively).

Setting the deadline for submission of revised Application No. 1 to the EEF

From now on, the EEF has established clear deadlines for the submission of the Grant Application (Application No. 1) revised by the Beneficiary. They are no more than 3 months from the date of sending by the EEF a notification about the finalization of this Application. Accordingly, if the HOA missed the deadline for submitting a revised Grant Application (Application No. 1), the EEF has the right to reject such an Application.

Attention! Beneficiaries who, as of March 22, 2024, have less than 30 calendar days left to finalize their Grant Applications (Application No. 1), have been given additional 30 calendar days for such finalization.
